PERSONAL CONSENT and ASSUMPTION OF RISK and RELEASE OF LIABILITY 

PARTICIPATION AGREEMENT:  I am representing my child or participating as an adult, staff member, employee, independent contractor, or coach and am choosing to participate in activities at TAG USA gymnastics. On behalf of myself and any of my registrants for participation for all activities at TAG USA Gymnastics Inc, or TAG Elite Athletics Inc. or TAG USA Sports Inc. (hereby known as TAG USA/TAG Elite) at 15900 W. St Rd. 84 in Sunrise, FL., I fully understand the nature of potential injuries associated with entering the facility, and participating or coaching in gymnastics, trampoline, parkour, ninja, inflatables, and all other gym activities. I assume all risk, liability, and medical costs for all injuries regardless of who is determined to be negligent. I state that we are in good health and physical condition and without any previous injury, surgery, or limitations to safely participate in all activities. When event conditions appear unsafe, I will immediately notify other staff and discontinue my and others' participation by walking away from the activity. We will follow all verbal and posted Rules of Participation and understand that no one is permitted to flip, run, jump, swing, climb or use any apparatus without specific permission additional coaching assistance. We will not touch or move any equipment. I understand that adults cannot walk on or utilize any apparatus, including spring floors, rod floors, tumble tracks, trampolines, bars, beams, mats, ropes, pits, inflatables, climbing activities, and all other equipment. I understand that all activities involve a high and likely risk of bodily injury, wounds, permanent disability, paralysis, or death which may be caused by our own actions or inactions, the action of others, unusual conditions of the event, uneven surfaces, or by other risks either not known to us or not readily foreseeable at the time, and even by the negligence of TAG USA/TAG elite equipment or employees at the facility and I state that I have freely chosen to enter the facility and participate in events knowing of injury risks and willfully accept and assume all personal risks and all responsibility, especially for my minor child. I will assume all costs of treatment or injury care by having personal health insurance to use, despite any negligence, for losses, injuries, healthcare costs, or other damages that are a result of our participation in any and all activities at, in, and outside of the TAG USA/TAG ELITE facility. I agree with this paragraph by my signature below. 

MY ASSUMPTION OF RISK and RELEASE & WAIVER OF LIABILITY

I, AGREE THAT I CHOOSE TO ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY FOR MY CHILD. I AGREE THAT EVEN IF TAG USA / TAG Elite USES REASONABLE CARE IN PROVIDING AN ACTIVITY, THERE IS A CHANCE I MAY BE SLIGHTLY SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CAN NOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, I AM GIVING UP MY RIGHTS AND MY RIGHT TO RECOVER MONIES OR DAMAGES FROM TAG USA / TAG Elite IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, OR ANY PROPERTY DAMAGE OR LOSS RESULTING FROM THE RISKS THAT ARE A NATURAL POR OF ANY ACTIVITY. I HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM AND NO ENTER THIS FACILITY, AND KNOW THAT TAG USA / TAG Elite DOES NOT ALLOW ANY OF MY OTHER PARTICIPANTS TO ENTER THIS FACILITY IF THIS LIABILITY RELEASE FORM IS NOT SIGNED. I agree that TAG USA / TAG Elite will not assume any legal or financial responsibility for any injuries that occur for any negligence. I hereby release, discharge, and promise not to litigate, no matter the issue, complaint, or negligence of TAG USA / TAG Elite and its respective administrators, coaches, directors, agents, officers, volunteers, and employees, contractors, other participants, corporate sponsors, advertisers, owners and lessees of the premises where activities take place, all known as the “Releases”. I also AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS all involved with TAG USA / TAG Elite, thereby releasing all others from liability, personal claims, and even negligent occurrences at or by TAG USA / TAG Elite. I declare that we have personal health insurance or a personal bank account which will be used in the event of any costs involved in a personal injury. I agree that if I, or anyone else, makes a claim on our behalf against any of the “Releases”, I will waive TAG USA / TAG Elite’s liability and agree to indemnify, save, and hold harmless each of the TAG USA/TAG Elite “Releases” from any loss, liability, damage, or cost, which may incur as the result of such a claim. I declare that our participation at TAG USA / TAG Elite is voluntary and reiterate that I understand the risk of injury or slip & fall on events on uneven surfaces, spring floors, trampolines, inflatable use, and all apparatus or equipment thereby waiving all liability or negligence of TAG USA / TAG Elite and personally assuming costs associated with any injury at TAG USA / TAG Elite’s facility. I agree with this paragraph by my signature. 

MY PERSONAL CONSENT 

I, agree to be financially responsible for the complete and total costs of anyone that I register for team, class, camp, or other activity and I agree with the “No Refund” and “Non Transfer” policy for all paid or registered participants in recreational classes, open gym play, team tuition, Day Camps, special activities, birthday parties, and all other events. I will follow the posted Rules of Participation, dress modestly, act in a calm moral manner and behave ethically. I will not move, remove, damage, or alter any property, equipment, documents, or work product belonging to TAG USA/ TAG Elite. I will not solicit or attempt to induce, directly or indirectly, any manner whatsoever any past, present or prospective customer, participant, team member, patron or coach, and staff member of TAG USA to utilize another facility providing the same or similar service as TAG USA. I will not disparage any facet or staff member of TAG USA. I agree not to demand from or litigate TAG USA/TAG Elite or any of its “Releases” from any and all claims, monetary disputes, employment disputes, costs from losses, injuries by negligence, physical damages, or any other demands to have been caused by or at TAG USA / TAG Elite. If litigation is instituted on my behalf despite my waiver of liability, I will immediately reimburse TAG USA and each of the “Releases” from any expenses, litigation and attorney fees, time loss, damages, and all costs that the “Releases” incur as the result of any claim associated with my employment participation at this facility or event. I agree that TAG USA can freely determine the activity location or equipment used for any event. TAG USA can freely use any coach and staff assistant for my class, team training, party, or other events within the facility. I agree with this paragraph by my signature below.
